No, because what you're sending IS spam. Call it "email marketing" all you like but it's still spammy as a canned ham.

Manage your list with a trusted provider like Aweber and you wont have this problem.

That is not the ideal way to go about email marketing. As mention earlier by another comment, you have to use an ESP (email service providers). There's a ton of them out there that you should look into and they're prices are all affordable. Try looking into a few listed below:
